Information for Counsel

Due to COVID-19, limited seating will be available in the courtroom restricted to the media and counsel. Litigants and the public may view argument in these matters in the Capitol’s rotunda or online. For additional information regarding attending oral argument in person or viewing remotely, please see the Information for the Media and Information for the Public section of this website.

After all exceptions and briefs in support are filed the Court will issue an order of argument on Wednesday, February 16 by 3:00 p.m. Please visit https://www.pacourts.us/assets/opinions/Supreme/out/February18Schedule.pdf to consult the order of oral arguments. While there will be no time limit for each argument, that schedule will provide an estimate of the time each argument is expected to last.

Everyone in attendance will be required to wear masks. Counsel may remove their mask while making their argument to the court.

Counsel will be permitted to present enlarged visuals to the Court on an easel that will be made available during argument, however visuals will be limited to those exhibits in the briefs and counsel shall reference the location of any visuals in their briefs during their arguments.

Persons shall not attend oral argument if they:

Are experiencing any symptoms of COVID-19 (fever or chills, cough, shortness of breath or difficulty breathing, fatigue, muscle or body aches, headache, new loss of taste or smell, sore throat, congestion or runny nose, nausea or vomiting, or diarrhea).

Have tested positive for COVID-19 within the past 5 days or are currently awaiting the results of a test, have been directed to isolate by a medical professional, or have had close contact with a person who has been diagnosed with COVID-19 within the past 5 days.

Arguing counsel in either of the above categories shall contact brian.minner@pacourts.us immediately upon not being able to attend argument session. Should other counsel not be available to argue, the exception will be submitted on the briefs and the schedule for argument will be adjusted accordingly.

Information for the Media

Five seats will be reserved for media in the courtroom on a rotating basis, as needed. Members of the media may contact Stacey Witalec (cell: 717-877-2997) or Kimberly Bathgate (cell: 717-317-1285) to arrange attendance. Media attending argument in the courtroom will be required to comply with the COVID protocols listed in the Information for Counsel section of this website.

Information for the Public

Audio and video of oral argument in these matters will be simulcast to the Capitol’s rotunda. For those unable to attend in person, audio for this hearing will be livestreamed to YouTube at https://youtu.be/J1h9eHwgWiU and the Pennsylvania Cable Network will be broadcasting audio and video at a later date.
