Information for Counsel
Counsel will not appear in person for oral argument sessions designated by the Court to be held remotely; all remote arguments will be conducted by advanced video communication technology. The remote arguments will be held at designated times indicated on the argument schedule.
Each party must designate one attorney to argue on behalf of the party. In cases involving more than one party on a side, counsel will be required to advise the Court in advance how they will divide their argument time. By separate notice, the Court has provided counsel that are scheduled to argue with detailed information, protocols, and technical assistance for the conduct of the remote arguments.
Information for the Media and the Public
Only designated counsel presenting the oral argument will have access to the videoconference session. All other interested participants – co-counsel, parties, the public and media, etc. – may view the arguments in real time through a public livestream web link. Links to view the arguments before panels and the Court en banc are included on the argument schedule.
The Commonwealth Court’s Internal Operating Procedures and the Pennsylvania Rules of Judicial Administration prohibit recording of oral arguments conducted and livestreamed by advanced video communication technology. See Section 502 of the Internal Operating Procedures of the Commonwealth Court, 210 Pa. Code § 69.502 (permitting only the recording by the Pennsylvania Cable Network (PCN) of en banc proceedings for future broadcast); Pennsylvania Rule of Judicial Administration 1910, Pa.R.J.A. 1910 (relating to broadcasting, recording and photography in the courtroom). Violation of this directive may result in the imposition of sanctions.
